The application to exclude evidence from a journalist charged with child pornography offences is allowed; the search warrants authorized under s. 487 of the Criminal Code (Cr.C.) by a presiding justice of the peace were invalid because they should have been authorized under section 488.01 Cr.C. by a competent judge according to the terms of that provision.
