The Court authorizes a class action on behalf of all persons who, since May 31, 2015, have paid to any of the respondent financial institutions – or to any of their affiliates – a prepayment charge, calculated using the interest rate differential formula, which exceeds the lender’s net economic loss, upon full or partial repayment of a fixed-rate hypothecary loan or a collateral hypothec on a property located in the province of Quebec.
